              Penalites for a DUI conviction vary in the State of Idaho.  In short, the more DUIs a person accumulates, the stiffer the penalties.  The penalties are even higher if you are convicted of an aggravated or excessive DUI.  As you review the charts below, pay attention to the amount of jail time each offense carries as well as the length of the license suspension.  Oftentimes the license suspension has the most dramatic impact on a client's life because it impacts their schooling, their families and their jobs.

    Regular DUI Offense .08-.20

    First DUI Offense

    • Misdemeanor violation
    • Jail: up to 6 months
    • Fines: up to $1,000
    • License suspension: 90 to 180 days                           





     Second DUI Offense

    • Misdemeanor violation
    • Jail: 10 days mandatory, up to 1 year
    • Fines: up to $2,000
    • License suspension: 1 year mandatory after release from confinement with no driving privileges of any kind
    • Ignition interlock mandatory

     

    Third DUI Offense

    • Felony violation
    • Jail: 30 days mandatory, up to 5 years
    • Fines: up to $5,000
    • License suspension: Up to 5 years, 1 year mandatory after release from confinement with no driving privileges of any kind
    • Ignition interlock mandatory

    Aggravated DUI Offense .20+

    First DUI

    • Misdemeanor violation
    • Jail: 10 days mandatory, up to 1 year
    • Fines: up to $2,000
    • License suspension: 1 year mandatory after release from confinement with no driving privileges of any kind

     

     

    Second (or more) DUI
    • Felony violation
    • Jail: mandatory 30 days in the county jail, or up to 5 years in the state penitentiary
    • Fines: up to $5,000
    • License suspension: up to 5 years, 1 year mandatory after release from confinement with no driving privileges of any kind
    • Ignition interlock mandatory
